These Terms & Conditions form the complete agreement & should be read before entering into the agreement.
1. Definitions
“Us”, “We” and “Our” Refers to QuickSell Store Ltd. registered in England. Trading from 104 Broughton Lane, Salford, Manchester. M7 1UF, UK. Registration No 07082123
“You”, “Your” and “Yours” refers to the person and owner of the goods.
“Goods”, "item" or "lot" refer to anything we have agreed to sell on an Auction website.
“Auction website” refers to eBay.co.uk , any other website or non web based sales platform.
“Buyer” refers to the person who bids the highest value for the goods, or purchases on the auction website and pays for these goods within the time stated in the auction.
“Sales Fees” refer to the agreed fees charged by the auction website or payment company for the process of listing, selling the goods or receiving payments and also refers to the commission charged by us to you at the rate agreed.
“Sale Price” refers to the price that the goods were sold to the buyer, excluding any additional costs for postage, packaging, insurance & delivery.
"Listing” refers to the sales description used to sell the goods.
2. Services
This agreement authorizes us to undertake the following services.
Check your proof of ID to ensure we can trade with you. Photo ID & proof of address may be required.
Receive, check, store and sell the goods on your behalf.
Photograph, describe and advertise the goods on an auction website.
Answer enquiries from potential buyers via email, fax, phone or in person.
Package and deliver the goods to the buyer or arrange collection from you.
Complete the transaction process by sending you the sale price less the sales fees as set out in clause 4 below.
3. Binding Bids
Our auctions will be run according to the rules of the auction website.
The final sale price will be determined by the highest bid which we reasonably accept and may not be under our control.
Upon receipt of the goods & payment from the buyer, you will pass title of ownership directly to them.
At no time do we become the owner of the goods. (When you deposit the goods with us it is solely for the purpose of undertaking the services set out in clause 2)
No other printed or electronic documents or conversation shall be construed to form any form of agency, partnership, sole, joint venture or liability outside these Terms between us & you.
You may not at any time bid for your own goods, nor may you authorize a 3rd party to bid on your behalf. You understand that you may not be able to withdraw items from the sales process if we have made commitments to buyers.
If you do you shall be in breach of this agreement, any actions against you are set out in clause 7.
4. Sales Fees and Payments
In return for us undertaking the services as set out in clause 2 you agree that we shall be paid a sales fee. Our sales fee is one third of the net sale price of the goods sold, to a minimum of £10.00 per sale. The net figure is calculated by deducting the sales fee from the sale price. We charge eBay sales fees at up to 12% of the sale price. We charge PayPal fees at 3.4% of the sale price + 20p per sale.
It is your responsibility to notify us of any enquiry or sale that has arisen from the listing and to advise the buyer to make the transaction with us. Our sales fee is due under all circumstances where the initial enquiry has been made as a result of the listing, even if the transaction is made away from the site.
Postage and packaging; It is not always possible to accurately estimate this price and any discrepancies or losses may be deducted from the final sale price prior to our fee being calculated.
We shall deduct our sales fee from the sale price prior to forwarding the remaining funds to you. We shall invoice you for any sales fees on payments collected by you. Payment must be made within 7 days. Any payment after this period will be subject to 10% interest per week. We shall remit, on request, the remainder of the sale price to you once payment has cleared and the returns period as defined in the listing has ended. If this is not requested for over 18 months any entitlement to the funds will pass to us. We may wait for your other goods to sell before processing payment. A dispute with the Site or a bank will pause this period. Payment shall be either directly into your bank account or via a cheque at your discretion.
5. Unsold Goods
Should the goods not sell on the auction website we shall re-list them or advise you with any recommendations. Should you not agree for the item to be re-listed, or the goods remain unsold, you shall at your expense, collect the item from us within 7 days of the end of the listing. We may at any time request that you collect your goods. Should you fail to collect the goods within 7 days you agree that full legal title to any uncollected items shall transfer to us and that at our absolute discretion, the goods may be disposed as we wish.
6. The Goods
You Confirm that
You are the legal owner of the property and you are authorized to sell the goods and that no 3rd party has any rights to the goods unless you have permission to act on someone else’s behalf. You must notify if any 3rd party has any rights over the goods.
That all trademarks, symbols, names and branding are authentic and not counterfeit.
You shall identify to us any damage or non working parts of the goods.
As the title of the goods remains your responsibility you shall ensure the goods are adequately insured.
Where the buyer wins an auction that requires collection from you, unless otherwise agreed in writing, you will make the goods available within 7 days from the point at which you are contacted by the buyer or us. It is your responsibility to ensure that the entire lot is available & easily accessible at the collection time and place agreed with the buyer otherwise you will be liable for any costs incurred.
You indemnify us for any loss or damage due to inaccuracies in your description, or any actions you take which affect the auction.
7. Breach of the terms & Conditions
We may at our discretion choose not to list any goods on an auction website at any time. Should we deem so, the goods may be suspended temporarily or permanently from the auction website. In addition we may also suspend or refuse our services either on a temporary basis for any of the following reasons.
You breach any part of this agreement.
We believe the goods may be stolen or have been used in any form of illegal activity.
You cannot provide us with adequate identification or other supporting documents we request.
If you request to withdraw an item from sale, you agree to pay a lot withdrawal fee of £10 per item.
You will be liable for any costs incurred for any action taken by you that breaches these terms & conditions
8. Our Responsibilities
We shall provide our services as set out in clause 2 with reasonable skill and care. We make no further warranties or representations as to the services, expressed, implied or otherwise. We shall not be responsible for any damage or loss caused to the goods even by our negligence. We are not liable for any loss or damage, direct, consequential or loss of profit, which you may suffer as a result of this agreement. In particular we make no representation about the sale price of your items. In all cases except where provided otherwise by statute, our absolute liability shall be limited to 50% of selling price of your item, or 25% of the agreed start price if unsold.
9.
This agreement shall commence on the day we receive the goods from you or on signature of this contract and shall end when the goods are.
Sold, delivered to the buyer, and you have received payment.
Unsold and the goods have been returned to you.
The goods have been deposed of in accordance with clause 5
The agreement is terminated early by us in accordance with clause 7
10. Personal Data
The Company will not publish your personal information on the Site or pass it to any third party unless required to do so by the Rules of the Site, e.g. in the event of dispute, or by law. The Company may from time to time contact the Seller with information about the Company's services but the Seller may opt-out of receiving such information at any time.
11. General
All Contracts to which these Terms apply shall be governed by the laws of the relevant territory within the UK in which you live and the courts of that territory shall have the exclusive right to deal with any dispute.
